Praise be to Allah alone,
The ownership of land is a necessity that human need calls and in order to own lands, there is a must of having legitimate ways of ownership to meet that need. This research aims to clarify and demonstrate those ways relating to make new ownership of lands that were not previously owned by anyone, and clarify its jurisprudential and systematic rules. So, this research was conducted to address this need, and to gather jurisprudential and practical systematic material to contribute in serving those interested in this important field.
This thesis contains the jurisprudential and systemic issues related to all types of roads through which land ownership is made in the regulations of the Kingdom of Saudi Arabia. First, the research began with defining the meaning of ownership, its sections, and its status in Islam-that includes great purposes-, clarify the regulations relating to the ownership of land, and the power of guardian to determine those controls. Then, this was followed by a description of the methods of making ownership from land ownership through renewal, its nature, its rule and its jurisprudential and regulatory rules and procedures. Followed by a description of how to make land ownership through grants, indicating types of grants, its controls and procedures and what is new within it. Then explaining how to make ownership of land by way of compensation, indicating its rule, procedures and controls. Then, it was followed by a description of land ownership method through purchasing it from the kingdom, indicating its rule, controls and types, then it discussed the issue of making land ownership through government companies, which is a type of modern ownership, that was not previously known. Finally, the research was concluded with some of the issues that relating to make land ownership, which need to be added to complete the benefit, such as documents of ownership, ownership of government facilities, and the parties involved in land ownership. The research ended by summarizing the most important research results and recommendations that have emerged through the search.
