Abstract |

The codification of judicial rulings such as medical errors cases with attempt to codify it in the specific and explicit articles can help judges, doctors, lawyers and others to access to their aim in easy and efficient way. Therefore, this thesis highlighted on this issue in attempting to fill the gap of processing of judiciary codification which Saudi Arabia seeks in its project to codify judicial rulings, and that the presence of the urgent need for the codification and legalization of judicial rulings in accordance with the provisions of Islamic law which is the constitution that based upon the Kingdom of Saudi Arabia in the judicial and other laws.
The plan of this thesis came in four chapters, the researcher at the first chapter talked about codification and its concept, inception as well as the advantages and disadvantages, with mentioned the attitude of Shariah's scholars and their views towards it, while also pointing to attempts of codification in Saudi Arabia and the importance of codifying judicial rulings generally and their relationship with medical errors.
In the second chapter, thesis present the medical errors in Islamic Jurisprudence and Saudi law with clarified the concept of medical error and its types, compensation, methods of affirmation in a court with indicate to its implications.
After that, the third chapter talked about legitimate health authorities in Saudi Arabia which is the entity authorized to judicial consideration of medical errors by clarified its inception and jurisdiction issue with given some practical examples of decisions of judicial rulings in the side of medical errors for use in the process of codification with criticism and analysis.
Finally, the thesis conclude at the last chapter with judicial code for medical errors which consider as a summary of this research, as the researcher worked hard in the formulation of judicial articles related medical errors in terms of the nature of doctor's work and medical errors, as well as sanctions, estimates and compensation about it, and then concluded a researcher at the conclusion of research to show the important results and recommendations such as founders a special legal of medical errors issues and the creation of specialized courts in this aspect with the reconsideration of the sanctions and estimated prescribed to medical errors in accordance with the provisions of Islamic Sharia. |
