Abstract |

his thesis has included verification for the second half of the explanation “Nazum ALmanar” which is named “Tamimat’u Qurrat’u Aini ALttaleb” in the fundamental jurisprudence, for jurist the participant the scholar the scientist Abdu ALLatif Bin Baha’a ALddin Bin Abdu ALBaqi AL Ba’ali who is famous for Al Baha’i who is deceased in (١٠٨٢H).
And this study has displayed the book inspection on three written copies, one of them is permitted by the handwritten of the author, I have tried to manifest the text in the most correct and fabulous maner, and I have divided the dissertation into two main sections, the first one has the translation of the author where I have made efforts to elicit what the books contained about the author in spite of the shortage of what has been mentioned about him. And the second section is inspection the text of the book presenting his method in an authorship and his resources that he has been citing by it.
The author showed in this examined section -which is the second half of the book- to the themes: The legislative proof research- Sunna of the Prophet (enact ment)- Consensus- Physiognomy- Approbation-and Indepedent reasoning
And as for the approach of the author in this explanation, he presented it once in an inclusive way and another time by utterance, either it comes in some verses related to each other, then he explains it in embedding explanation excluding the systemic terms explanation at most, or it comes by pronunciation says: his utterance so ….
Then he explains it, where he said in his explanation (Almatin) which he means (Matin Al-manar) for Nasafi.
So he by himself organized the text (AL-manar), Then he explained it in this explanation, clearing the obscurities and explaining the ambiguities without any deficiency or tediousness, exposing to some views of Shaafi’s and mentioning their evidences and discussing it, to outbalance the doctrine of AL-Hanafi.
AT conclusion, we ask Almighty ALLAH a well life end and reaching the aims and constant success. |
