This study aimed to collect Jurisprudential rules and standards which included through Rawd Al-Murbi' book of Family Jurisprudence in a file to be easy reference, connect verbal side in Jurisprudential Rules and Standards with applied side that showed through multi applications for each rule or standard, also show Ibn-Hanbal followers and Imam Al-Bahoti rules art.
The research included introduction, three chapters, and conclusion. Introduction contained the subject importance, choice reasons, previous studies, methodology and plan. The research divided to three chapters, 1st chapter included three sections and 1st section presents identification for Imam Al-Bahoti, 2nd section presents identification of Rawd Al-Murbi' Book, 3rd section presents identification of Jurisprudential Rules and Standards. 2nd chapter included Jurisprudential Rules and Standards in Family Jurisprudence through Rawd Al-Murbi' Book which contained five sections, 1st section rules of marriage book and rule of 2nd section is rules of divorce book, 3rd section is Al-Zahar (husband who swear a lot) book, 4th section is rules of Al-Ae'dad (duration after wife spend to marry after husband death or divorce), 5th section is rules of A-l-Nafaqat (costs). Chapter three Jurisprudential Rules in Family Jurisprudence through Rawd Al-Murbi' Book and included seven sections, 1st section is standards of Al-Niqah (marriage) book, 2nd section is standards of divorce book, 3rd section is standards Al-Aylaa (leave wife without sexual rights) book, 4rd section is standards Al-Zahar (husband who swear a lot) book, 5th section is standards of Al-La'an (husband who doubt in his wife cheating) book, 6th section is standards of Al-Rada'a (breastfeeding) book, 7th section is standards of Al-Nafaqat (costs) book, and conclusion with most important results that showed that Rawd Al-Murbi' Book contained great scientific benefit because of containing many explanations, branches, matters, proofs which presented as rules and standards for many matters and subjects.
Also, through the study showing the opportunity of Ibn-Hanbal followers generally and Imam Al-Bahoti especially for Jurisprudential Rules and Standards through big amount of rules and standards which included in their books, In addition to their unique rules and standards which proof that this art is inherent in their books. Rules of the study in the research after revision reached to forty two rules and standards reached to forty two standards. |
